Pay-cut clauses can block Sweden’s expert-tax relief

Foreign employees can lose access to Sweden’s salary-based expert-tax relief even when their pay has never fallen below the threshold, if their contract allows such a reduction.
The Supreme Administrative Court ruled on Tuesday that agreed remuneration must, in principle, exceed the qualifying level each month throughout the employment. A clause making lower pay conditional on a future event still counts.
The case involved a footballer employed by HBK Elitfotboll AB. His three-year contract allowed his salary to fall below the threshold if the club was relegated from Allsvenskan to Superettan. The court rejected the club’s appeal against the refusal of relief.
Expert-tax relief exempts 25% of qualifying employment income from tax for eligible foreign experts, researchers and other key employees. The ruling concerns the route based on salary, rather than an assessment of specialist skills.
The judges drew an important distinction: temporary reductions in payments because of sickness, parental leave or similar circumstances do not affect the right to relief. It is the agreed remuneration that matters.
The decision therefore makes a contract’s contingent pay terms relevant before any actual cut takes place.
